A client attacked José Alba, a bodega employee, on July 7, 2022, over a bag of potato chips. Alba attempted to de-escalate, but after being forced into a wall, defended himself with a knife, murdering the assailant.

In exercising his prosecutorial discretion, Bragg opted to prosecute Alba and set the bail amount at $250,000.

After attempting to use Alba’s knife to stab the deceased attacker, the dead attacker’s girlfriend also attacked Alba with her own knife. Bragg decided not to prosecute her.

After receiving a lot of criticism, Bragg finally decided to dismiss the homicide charges against Alba because it was impossible to establish Alba was responsible for the death at trial.

The Washington Post reported on September 6, 2022, that Stephen Bannon will be prosecuted on September 8 by Bragg’s prosecutors on the same fraud-related charges for which the then-President Trump had granted him a federal pardon in 2020.

The peril that Mr. Bannon seemed to have avoided with a 2021 presidential pardon was revived on September 8 when Bannon was charged with deceiving Citizens who intended to donate to the building of a southern border wall. He pled not guilty.
